Terms of Service

These Terms of Service ("Terms") govern your use of BarkArt.co, which is operated by Lukas Labs LLC, an Arizona limited liability company doing business as BarkArtCo ("we," "us," or "our"). By creating an account or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy and Shipping Policy.

1. The Service

BarkArt.co turns photos of your pet into AI-generated artwork. You upload a photo and choose an art style, we paint your portrait with AI, and you can order it printed on a canvas, framed print, blanket, mug or ornament that is shipped to you. We also make personalized coloring books and wall calendars starring your dog. Printing and shipping are handled by our print partner, Printful.

2. Eligibility and Accounts

You must be at least 18 years old to create an account and place orders. You are responsible for keeping your sign-in email and linked accounts secure, and for all activity under your account. Please give accurate information, especially your shipping address.

3. Free Portraits and Daily Limits

Creating portraits is free, up to a daily limit per account (currently 5 per 24 hours). Revisions count toward the limit, and attempts that fail don't. We may change the limit, or pause new portraits when demand is high. Free portraits have no cash value. Using multiple accounts or automated tools to get around the limit is not allowed.

4. Your Photos

You may only upload photos that you took or have permission to use. By uploading a photo, you confirm that it does not infringe anyone's rights and does not contain illegal, obscene or hateful content. You keep all ownership of your photos. You give us a limited license to store and process them, and to share them with our AI and printing providers, only to provide the service to you.

5. AI-Generated Artwork

Artwork is created by artificial intelligence, and results vary. We can't guarantee that any design will capture every detail of your pet, and similar artwork may be generated for other customers. You can preview your artwork and request revisions before ordering. By ordering, you approve the design as shown. Preview images include a watermark that does not appear on your print. Printed colors may differ slightly from your screen.

Personalized coloring books. After you pay, we draw your dog and show you the drawings before we make the book. You can request up to two changes to how your dog is drawn, or, if it doesn't look like your dog, cancel before approving for a full refund. When you approve the drawings, we draw your dog into every page and send or print your book; you approve how your dog looks, and we check every page before it goes out. Nothing is made, sent or printed until you approve; if you haven't answered, we'll remind you. (Orders placed before October 5, 2026 show a watermarked preview of every page instead.) Each book is made just for you, so after approval we don't accept returns or give refunds for a change of mind. A printed book that arrives damaged or misprinted is replaced free, as described in our Refund Policy.

Personalized calendars. After you pay, you tell us about your dogs (up to 3), their birthdays and up to 15 dates of your own. We make the cover first so you can check that your dogs look right; then we make the 12 months and show you every page. You can redo up to 5 pictures in total, fix dates and the cover title free, and cancel for a full refund at any time before you approve. Please check every name, date and spelling before approving: we print exactly what you approve. Nothing is printed until you approve; if you haven't answered, we'll remind you. Holidays shown are US holidays. Each calendar is made just for you, so after approval we don't accept returns or give refunds for a change of mind. A calendar that arrives damaged or misprinted is replaced free, as described in our Refund Policy.

6. Who Owns the Artwork

Once you order a product, you own that physical product. You may use the digital artwork created from your photo for personal, non-commercial purposes, such as sharing it on social media or using it as a phone background. You may not sell the artwork, or products made from it, without our written permission. We will not use your photos or artwork in our advertising without your permission. The BarkArt.co name, website, software and art styles belong to Lukas Labs LLC.

7. Orders, Pricing and Payment

All prices are in US dollars. Payment is processed securely by Stripe. Shipping is charged at cost (what our print partner charges to ship your items) and is shown before you pay. Sales tax is calculated at checkout based on your shipping address. Your order is accepted once payment is confirmed. Because every product is made to order, orders can't be canceled or changed once they have gone to print. We may cancel and fully refund an order if we can't fulfill it, for example because the product is unavailable or the order looks fraudulent. If we list a price by mistake, we may cancel the affected order and refund you in full.

8. Shipping, Refunds and Replacements

We ship to the United States and Canada. Delivery times are estimates. Customers outside the US pay any customs duties or import taxes. If an item arrives damaged or with a printing defect, we will replace it, or refund that item, as described in our Refund Policy. We do not accept returns or give refunds for change of mind. 10. Disclaimer of Warranties

Except for the replacement and refund commitments in our Refund Policy, the service and artwork are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent allowed by law. We don't promise that the service will always be available or error-free.

11. Limitation of Liability

To the fullest extent allowed by law, Lukas Labs LLC is not liable for any indirect, incidental, special or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid for the order that the claim relates to. Some places don't allow these limits, so they may not fully apply to you.

12. Indemnity

You agree to cover any claims, losses or costs, including reasonable legal fees, against Lukas Labs LLC that arise from photos you upload or from your breach of these Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-law rules. If you have a problem, please email us first. Most issues can be solved quickly. Any dispute that can't be resolved informally will be decided in the state or federal courts located in Arizona, and you and we agree to those courts' jurisdiction. Either of us may instead bring a claim in small claims court if it qualifies. If you live in Canada or elsewhere, this doesn't take away any consumer protection rights that your local law gives you.

14. Termination

You can stop using BarkArt.co and ask us to delete your account at any time. We may suspend or end access for anyone who breaks these Terms. Orders already paid for will still be fulfilled or refunded.

15. Changes to These Terms

We may update these Terms from time to time and will change the "Last updated" date above. Changes apply to orders placed after they are posted.
